Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Topologis platform at topologis.com (the "Service"), operated by Topologis VCC, registered in Bulgaria ("Topologis," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Topologis is a cloud-based geographic information system (GIS) that allows users to import geodata, style and filter map layers, create shareable views, and embed maps on external websites.

2. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials. Do not share your login with others.
  • Each editor seat is for one individual. Sharing editor credentials between multiple people is not permitted.
  • You must be at least 16 years old to create an account.
  • You are responsible for all activity that occurs under your account.

3. Plans and billing

Free plan

The Free plan allows one editor with limited projects (up to 5) and limited storage (100 MB). Free plan views include "Powered by Topologis" branding.

Pro plan

The Pro plan is billed per editor seat at the rate displayed on our pricing page (currently $29/editor/month for monthly billing, with a discount available for annual billing). You may add or remove seats at any time, and billing will adjust accordingly.

Enterprise plan

Enterprise plans are custom-priced. Contact us for details.

Payment

  • Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service.
  • Subscriptions renew automatically at the end of each billing period (monthly or annual) unless canceled.
  • All fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes.

Cancellation and refunds

  • You may cancel your subscription at any time. Your plan remains active until the end of the current billing period.
  • We do not provide prorated refunds for partial billing periods as a matter of course. However, we may issue refunds at our discretion in cases such as billing errors or extended service disruptions.

Changes to pricing

  • We may change pricing with at least 30 days' notice. Price changes take effect at the start of your next billing period after the notice period.

4. Your data

Ownership

You retain all ownership rights to the data you upload to Topologis. We do not claim any intellectual property rights over your geodata, projects, styles, or configurations.

License to us

By uploading data to the Service, you grant us a limited license to store, process, display, and transmit that data solely for the purpose of providing the Service to you. This license ends when you delete the data or your account.

Your responsibility

  • You are responsible for ensuring you have the right to upload and share any data you import into Topologis.
  • You must not upload data that you do not have permission to use, or that violates any applicable law.

Data deletion

When you delete a project, layer, or your account, we delete the associated data from our systems within 30 days. Some data may be retained where required by law (for example, invoice records for up to 10 years).

5. Shared views and embeds

  • When you create a shared view (secret link) or embed, anyone with the link or access to the embed can view the map data included in that view.
  • You are responsible for managing access to your shared links and embeds, including revoking access when appropriate.
  • On the Pro plan, you can restrict embeds to specific domains using the domain allowlist and revoke/rotate embed access.
  • We are not responsible for unauthorized access that results from you sharing a link or failing to revoke access.
  • Embeds are intended for normal website usage. We reserve the right to rate-limit or suspend embed access if we detect automated, abusive, or non-human traffic patterns (such as scraping, rapid automated reloads, or bot activity). Normal visitor traffic to your website, regardless of volume, is not subject to limits.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to the Service or other users' accounts.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use the Service to store or distribute malware.
  • Scrape, crawl, or use automated tools to access the Service in a way that exceeds reasonable use.
  • Share editor credentials between multiple individuals.
  • Circumvent any usage limits, quotas, or access controls.
  • Resell, sublicense, or offer the Service as part of your own product or platform without prior written agreement.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Availability and support

  • We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation.
  • We may perform maintenance that temporarily affects availability. We will try to provide advance notice when possible.
  • Support is provided via our contact form on a reasonable-effort basis. Enterprise plans may include an SLA with defined response times.

8. Intellectual property

  • The Service, including its design, code, and documentation, is owned by Topologis VCC and is protected by applicable intellectual property laws.
  • "Topologis" and the Topologis logo are trademarks of Topologis VCC. You may not use them without prior written permission, except as required for attribution on Free and Pro plans.
  • These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described here.

9. Third-party services

The Service integrates with third-party services including Stripe (payments) and Google (OAuth sign-in, Sheets integration). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Limitation of liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for any loss or corruption of your data, except where caused by our gross negligence or willful misconduct.

11. Force majeure

We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet or infrastructure outages, third-party hosting failures, cyberattacks, pandemics, or labor disputes. If such an event continues for more than 30 consecutive days, either party may terminate these Terms by written notice.

12. Indemnification

You agree to indemnify and hold harmless Topologis VCC from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Termination

  • You may stop using the Service and delete your account at any time.
  • We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
  • Upon termination, your right to use the Service ends. We will delete your data in accordance with our Privacy Policy.

14. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of Bulgaria.

Before initiating any legal proceedings, the parties agree to attempt to resolve any dispute arising from or relating to these Terms or the Service by contacting each other directly and negotiating in good faith for a period of at least 30 days. If the dispute is not resolved within that period, either party may bring proceedings in the courts of Bulgaria.
